3. Section 141 — Comprehensive Debt Limitation Policy
Comprehensive Debt Limitation Policy — व्यापक ऋण सीमा नीति
State Government ऐसी policy बनाएगी जो Municipalities द्वारा लिए जाने वाले: Loans, Short-term Loans पर लागू होगी।
इस policy में मुख्यतः:
1. Loan लेने के General Principles — नगरपालिका किन principles के अनुसार borrowing करेगी।
2. Maximum/Permissible Loan Limit — Municipality की financial capacity को ध्यान में रखते हुए कितनी borrowing हो सकती है।
3. Rate of Interest — Loan पर interest rate।
4. Terms and Conditions — Loan की conditions।
5. Repayment Period — Loan कितने समय में repay होगा।
Section 141 — सबसे महत्वपूर्ण बात: Municipality अपनी borrowing capacity स्वतंत्र रूप से तय नहीं करती। Framework: State Government → Debt Limitation Policy → Municipality
“Financial Capacity” क्यों महत्वपूर्ण? Loan limit निर्धारित करते समय केवल Municipality की जरूरत नहीं देखी जाती। देखा जाता है: Municipality कितना debt safely service कर सकती है? अर्थात्: Repayment Capacity — पुनर्भुगतान क्षमता। इस concept को Section 141 और Section 142 दोनों के साथ पढ़ें।
4. Section 142 — Municipality की Loan लेने की Power
Municipality: अपने meeting में resolution पास करके loan raise कर सकती है। लेकिन: Section 141 की Debt Limitation Policy की limits के भीतर।
Loan किन उद्देश्यों के लिए?
(a) Construction of Works — Act के तहत works का construction।
(b) Land & Building Acquisition — Municipal purposes के लिए land, buildings की acquisition।
(c) State Government Debt — State Government को payable debt चुकाने के लिए।
(d) Existing Municipal Loan Repayment — Act के तहत पहले लिए गए loan को repay करने के लिए।
(e) Public Utility Concern — ऐसी public utility concern acquire करना जिसकी service Municipality Act के तहत provide कर सकती है।
(f) Vehicles & Machinery — Municipal purposes के लिए आवश्यक vehicles, machinery खरीदना।
(g) Other Statutory Borrowing Purpose — ऐसा कोई अन्य purpose जिसके लिए Act या किसी अन्य लागू कानून के तहत Municipality borrow करने के लिए authorized है।
Section 142 — Loan Limit से अधिक Borrowing: यदि proposed loan Section 141 की prescribed limit से अधिक है, तो Previous Sanction of State Government आवश्यक होगी। State Government sanction में देखेगी: purpose, quantum, rate of interest, repayment period, other terms and conditions.
Municipality किनसे Loan ले सकती है? Section 142 के framework में Municipality State Government से loan ले सकती है। इसके अलावा Statutory Body या Public Sector Corporation से भी loan ले सकती है।
Borrowed Money का Misuse नहीं: Loan जिस purpose के लिए लिया गया है, उसी purpose के लिए इस्तेमाल होना चाहिए। किसी दूसरे purpose में लगाने के लिए Previous Sanction of State Government आवश्यक है।
Loan से Salary नहीं — बहुत महत्वपूर्ण EO/RO trap: Section 142 के तहत उठाए गए loan का पैसा Municipality के officers/employees की salary या allowances देने में सामान्यतः इस्तेमाल नहीं किया जा सकता। Exception: ऐसे employees जो exclusively उस purpose के लिए employed हैं जिसके लिए loan लिया गया है।
Formula: Loan → Project ❌ Loan → General Salary ✅ लेकिन: Loan-purpose exclusively employed staff → permissible
Section 142 — Golden Rule: Loan is purpose-specific. Loan लेने के बाद Purpose बदलना = State Government sanction
5. Section 143 — Bank Credit Account
यदि Section 142 के तहत loan raise करने की State Government से sanction मिल गई है, Municipality actual loan raise करने के बजाय या उसका कुछ हिस्सा Scheduled Bank से Credit ले सकती है। यह Municipality के नाम के Cash Account में रखा जाएगा।
Section 143 — Mortgage: Bank credit को secure करने के लिए Municipality State Government की sanction से Municipality में vested properties को mortgage कर सकती है। Mortgage: credit amount या cash account से समय-समय पर advanced amounts, interest की repayment secure करने के लिए हो सकता है।
Exam Trap: कथन: Municipality बिना State Government sanction के municipal property mortgage कर सकती है। ❌ सही: State Government sanction आवश्यक है।
6. Section 144 — Short-Term Loan
Municipality Short-Term Loan ले सकती है। लेकिन: Section 141 Debt Limitation Policy की limits के भीतर। Loan: 12 months से अधिक नहीं हो सकता।
Short-Term Loan किससे? Any Scheduled Bank से। और State Government-approved terms और security पर loan लिया जा सकता है।
Short-Term Loan का Purpose: Section 144 का loan Section 142(1) में specified purposes के लिए नहीं होना चाहिए। यानी Section 142 वाला long-term/statutory borrowing framework और Section 144 short-term borrowing अलग हैं।
Section 144 — Master Formula: Short-Term Loan = ≤ 12 Months और: Scheduled Bank + Debt Limit + State-approved terms/security

8. Section 145 — Sinking Fund
Sinking Fund — सिंकिंग फंड — ऋण चुकाने के लिए बनाया गया आरक्षित कोष
Municipality को Section 142 के प्रत्येक loan के लिए Sinking Fund establish करना होगा।
Sinking Fund का उद्देश्य: इस Fund में हर year इतनी राशि जमा की जाएगी कि loan की approved repayment period के भीतर borrowed money repay हो सके।
Sinking Fund — याद रखने की Trick: हर Loan → अपना Sinking Fund अर्थात्: One Loan → One Sinking Fund
9. Section 146 — Sinking Fund का उपयोग
Sinking Fund: उसी loan या उसके किसी part को discharge करने के लिए इस्तेमाल होगा जिसके लिए fund बनाया गया है। जब तक वह loan पूरी तरह discharge नहीं हो जाता: Fund किसी अन्य purpose में इस्तेमाल नहीं होगा।
Section 146 — Golden Rule: Sinking Fund = Loan-specific ❌ Wrong: Sinking Fund → General Municipal expenditure ✅ Correct: Sinking Fund → संबंधित loan repayment
10. Section 147 — Sinking Fund Contribution बंद करना
सामान्यतः Municipality हर साल Sinking Fund में payment करती है। लेकिन यदि Fund में मौजूद amount इतना हो जाए कि approved interest rate से accumulate होने पर वह loan को approved repayment period के भीतर पूरी तरह repay करने के लिए sufficient होगा, तो Further payments discontinue किए जा सकते हैं।
Section 147 — Important Condition: Payment बंद करने का आधार: केवल Fund में बड़ी राशि होना नहीं है। बल्कि: Fund amount + sanctioned interest accumulation से पूरा loan approved period में repay हो सके।
11. Section 148 — Sinking Fund Investment
Sinking Fund में जमा money को Municipality as soon as possible invest करेगी। Permitted investments: (a) Government Securities (b) Central/State Government guaranteed securities (c) State Government द्वारा approved other public securities
Investment का उद्देश्य: इन investments को future loan repayment के लिए hold किया जाता है।
Investment से प्राप्त Income: Investment से कोई amount/return प्राप्त होने पर उसे भी Sinking Fund में as soon as possible credit किया जाएगा और फिर statutory manner में reinvest किया जाएगा।
Multiple Sinking Funds: दो या अधिक Sinking Funds की money Municipality के discretion पर एक Common Fund में collectively invest की जा सकती है। लेकिन इसका अर्थ यह नहीं कि underlying liabilities समाप्त हो जाती हैं। Securities को individual Sinking Funds में separately allocate करना आवश्यक नहीं है।
Investment को बदलना: Section 148 के तहत investment समय-समय पर vary या transpose की जा सकती है, लेकिन Section 148(1) की investment restrictions के अधीन।
12. Section 149 — Loan Repayment
हर Section 142 loan approved repayment period के भीतर repay होना चाहिए।
Repayment के दो Sources:
Option 1: Sinking Fund से repayment।
Option 2: Sinking Fund पर्याप्त न हो तो: Sinking Fund + Section 142 के तहत raised loan के combination से repayment। लेकिन: State Government approval के अनुसार।
Section 149 — Important Trap: कथन: Loan की repayment केवल Sinking Fund से ही हो सकती है। ❌ यदि Sinking Fund insufficient है, statutory framework के अनुसार approved additional loan source भी इस्तेमाल हो सकता है।
13. Section 150 — Annual Statement
हर वर्ष के अंत में: Chief Municipal Officer एक Annual Statement तैयार करेगा और Municipality को submit करेगा।
Annual Statement में क्या होगा? (चार मुख्य चीजें):
(a) उस वर्ष Sinking Fund में paid amount।
(b) उस वर्ष किए गए last investment की date।
(c) Year-end पर Municipality के पास securities का aggregate amount।
(d) Section 149 के तहत loan repayment में applied aggregate amount।
Annual Statement की Copy: Chief Municipal Officer Annual Statement की copy State Government को भी submit करेगा।
Section 150 Memory Trick — P–I–S–R: P — Payment into Sinking Fund, I — Investment date, S — Securities amount, R — Repayment amount
14. Section 151 — Annual Examination
सभी Sinking Funds हर वर्ष Auditor द्वारा examine किए जाएंगे।
Auditor क्या देखेगा? Auditor check करेगा कि Cash और Securities की value उस amount के बराबर है या नहीं जो Sinking Fund में होना चाहिए था। यह calculation इस assumption पर होगी कि: Section 148 investments regularly हुए; investment interest regularly received हुआ।
Expected Sinking Fund Amount: Expected amount की calculation Section 145 में किए गए payments के basis पर होगी।
Securities की Value: सामान्यतः Current Value ली जाएगी। लेकिन यदि securities maturity से पहले face value के बराबर या उससे अधिक redemption के लिए due हो जाएँ, तो Redemption Value लेने का statutory rule है।
Deficit होने पर: यदि Auditor deficit certify करता है, तो Municipality को Forthwith Sinking Fund में deficit amount pay करना होगा। Exception: State Government gradual readjustment को specially sanction कर सकती है।
Excess होने पर: यदि Sinking Fund में required amount से अधिक cash + securities हैं, तो Auditor excess certify करेगा। इसके बाद Municipality Excess amount → Municipal Fund → General Account transfer करेगी।
Deficit/Excess Dispute: यदि Municipality को Auditor के deficit/excess certificate की accuracy पर dispute है, तो पहले statutory financial adjustment के बाद matter State Government को refer किया जा सकता है। State Government का decision Final होगा।

16. CHAPTER IX — Commercial Projects
अब Act का नया dimension शुरू होता है: Commercial Projects + Private Sector Participation। इसका उद्देश्य municipal infrastructure को commercial basis और external agencies की participation के माध्यम से develop करना है।
Section 152 — Commercial Projects
Municipality स्वयं या Public/Private Sector Agencies के माध्यम से commercial infrastructure projects undertake कर सकती है। Activities में: planning, construction, operation, maintenance, management शामिल हैं।
Commercial Projects के Examples: District Centres, Shopping Centres, Bus Terminals, Truck Terminals, Tourist Lodges with Commercial Complexes और Other Commercial Projects commercial basis पर।
Section 152 — Key Concept: Municipality केवल tax/fees collect करने वाली संस्था नहीं है। वह Commercial Infrastructure Developer/Manager भी हो सकती है।
Section 153 — Project by Municipality/Other Agency
Section 153 municipal infrastructure और services के projects में other agencies की participation को allow करता है। लेकिन State planning/development/operation/maintenance/management laws के अधीन।
किन Functions के Context में? Section 153: Sections 45, 46 और 47 में specified municipal functions के discharge से जुड़ा है।
कौन-कौन Participate कर सकता है? Municipality project में participation के लिए: Company, Firm, Society, Trust, Body Corporate, Institution, Government Agency, किसी अन्य कानून के तहत agency के साथ काम कर सकती है।
Participation किन Activities में? Other agency: Financing, Construction, Maintenance, Operation में participate कर सकती है।
Section 153 — Three Modes:
(A) Urban infrastructure/service project में agency participation promote करना।
(B) Private sector company आदि के project को Private Sector Participation Agreement के तहत consider/approve करना।
(C) Government/other statutory agency के साथ project undertake/approve करना।
Section 154 — Private Sector Participation Agreements
Private Sector Participation Agreements: Rules द्वारा prescribed होंगे। लेकिन Act ने illustrative list भी दी है।

Section 156 — City Development Plan
हर Municipality: City Development Plan (CDP) prepare करेगी। इसकी periodicity, chapters, material, schemes Government द्वारा बनाए गए rules के अनुसार prescribed होंगे।
City Development Plan किससे Consultation में? सबसे पहले District Collector के साथ consultation। और district-level officials से भी consultation।

Metro Region होने पर: यदि Municipality किसी Metro Region का हिस्सा है, तो City Development Plan Metropolitan Planning Committee को भेजा जाएगा। उद्देश्य: Metro Region Development Plan में inclusion।
Metro Region का हिस्सा नहीं होने पर: यदि Municipality Metro Region का हिस्सा नहीं है: City Development Plan District Planning Committee को भेजा जाएगा। उद्देश्य: District Master Development Plan में inclusion।
Planning Committee के बाद: Metropolitan Planning Committee या District Planning Committee due deliberations के बाद City Development Plan या उसके appropriate elements को Metro Region Development Plan या District Master Development Plan में शामिल करेगी।

3. Section 141 — Comprehensive Debt Limitation Policy
Comprehensive Debt Limitation Policy — State Government shall frame a policy applicable to Loans and Short-term Loans taken by Municipalities.
Main elements of this policy:
1. General Principles of taking Loan.
2. Maximum/Permissible Loan Limit considering financial capacity.
3. Rate of Interest.
4. Terms and Conditions.
5. Repayment Period.
Section 141 — Most important: Municipality does not independently determine its borrowing capacity. Framework: State Government → Debt Limitation Policy → Municipality
Why “Financial Capacity” matters? While determining loan limit, not just Municipality's need but also its ability to safely service debt — Repayment Capacity — is considered. Read this concept with both Sections 141 and 142.
4. Section 142 — Power of Municipality to take Loan
Municipality may raise loan by passing a resolution in its meeting. But: within the limits of Section 141 Debt Limitation Policy.
Purposes of Loan:
(a) Construction of Works under the Act.
(b) Acquisition of Land & Buildings for municipal purposes.
(c) Repayment of debt payable to State Government.
(d) Repayment of existing municipal loan taken under the Act.
(e) Acquisition of public utility concern whose service Municipality can provide under the Act.
(f) Purchase of Vehicles & Machinery for municipal purposes.
(g) Any other statutory borrowing purpose for which Municipality is authorized.
Section 142 — Borrowing beyond Loan Limit: If proposed loan exceeds Section 141 prescribed limit, Previous Sanction of State Government is required. State Government sanction considers purpose, quantum, rate of interest, repayment period, and other terms and conditions.
From whom can Municipality take Loan? Under Section 142, Municipality may take loan from State Government, Statutory Body, or Public Sector Corporation.
No misuse of Borrowed Money: Loan must be used for the purpose for which it was taken. Using it for any other purpose requires Previous Sanction of State Government.
Loan not for Salary — crucial EO/RO trap: Money raised under Section 142 generally cannot be used for salary or allowances of officers/employees. Exception: employees exclusively employed for the purpose for which loan was taken.
Formula: Loan → Project ❌ Loan → General Salary ✅ But: Loan-purpose exclusively employed staff → permissible
Section 142 — Golden Rule: Loan is purpose-specific. Changing purpose after taking loan = State Government sanction.
5. Section 143 — Bank Credit Account
If State Government sanction is obtained to raise loan under Section 142, Municipality may instead of actually raising loan, or for part of it, take Credit from Scheduled Bank. This shall be kept in Cash Account in the name of Municipality.
Section 143 — Mortgage: To secure bank credit, Municipality may, with State Government sanction, mortgage properties vested in Municipality. Mortgage may be to secure credit amount, advances, and interest.
Exam Trap: Statement: Municipality can mortgage municipal property without State Government sanction. ❌ Correct: State Government sanction is required.
6. Section 144 — Short-Term Loan
Municipality may take Short-Term Loan. But: within Section 141 Debt Limitation Policy limits. Loan: shall not exceed 12 months.
From whom Short-Term Loan? Any Scheduled Bank. On State Government-approved terms and security.
Purpose of Short-Term Loan: Loan under Section 144 shall not be for purposes specified in Section 142(1). Section 142 long-term/statutory borrowing framework and Section 144 short-term borrowing are distinct.
Section 144 — Master Formula: Short-Term Loan = ≤ 12 Months and: Scheduled Bank + Debt Limit + State-approved terms/security

8. Section 145 — Sinking Fund
Sinking Fund — reserve fund created for loan repayment
Municipality shall establish a Sinking Fund for every loan under Section 142.
Purpose of Sinking Fund: Such amount shall be paid into this Fund every year so that borrowed money can be repaid within approved repayment period.
Trick to remember: Each Loan → its own Sinking Fund i.e., One Loan → One Sinking Fund
9. Section 146 — Use of Sinking Fund
Sinking Fund shall be used to discharge the same loan or any part thereof for which the fund was created. Until that loan is fully discharged, the Fund shall not be used for any other purpose.
Section 146 — Golden Rule: Sinking Fund = Loan-specific ❌ Wrong: Sinking Fund → General Municipal expenditure ✅ Correct: Sinking Fund → related loan repayment
10. Section 147 — Discontinuance of Sinking Fund Contribution
Normally Municipality pays into Sinking Fund every year. But if the amount in the Fund becomes sufficient that, with accumulation at approved interest rate, it will repay the loan in full within approved repayment period, Further payments may be discontinued.
Section 147 — Important Condition: Basis for stopping payment is not merely a large amount in Fund. Rather: Fund amount + sanctioned interest accumulation enables full repayment within approved period.
11. Section 148 — Sinking Fund Investment
Municipality shall invest money in Sinking Fund as soon as possible. Permitted investments: (a) Government Securities (b) Central/State Government guaranteed securities (c) Other public securities approved by State Government.
Purpose of Investment: These investments are held for future loan repayment.
Income from Investment: Any amount/return from investment shall also be credited to Sinking Fund as soon as possible and then reinvested in statutory manner.
Multiple Sinking Funds: Money of two or more Sinking Funds may be collectively invested in a Common Fund at Municipality's discretion. But this does not mean underlying liabilities are extinguished. It is not necessary to separately allocate securities to individual Sinking Funds.
Changing Investment: Investment under Section 148 may be varied or transposed from time to time, subject to Section 148(1) investment restrictions.
12. Section 149 — Loan Repayment
Every Section 142 loan shall be repaid within approved repayment period.
Two Sources of Repayment:
Option 1: Repayment from Sinking Fund.
Option 2: If Sinking Fund is insufficient: combination of Sinking Fund + loan raised under Section 142. But: as per State Government approval.
Section 149 — Important Trap: Statement: Loan repayment can only be from Sinking Fund. ❌ If Sinking Fund is insufficient, statutory framework allows approved additional loan source also.
13. Section 150 — Annual Statement
At the end of each year: Chief Municipal Officer shall prepare an Annual Statement and submit it to Municipality.
Contents of Annual Statement (four main items):
(a) Amount paid into Sinking Fund during that year.
(b) Date of last investment made during that year.
(c) Aggregate amount of securities held by Municipality at year-end.
(d) Aggregate amount applied to loan repayment under Section 149.
Copy of Annual Statement: Chief Municipal Officer shall also submit a copy to State Government.

14. Section 151 — Annual Examination
All Sinking Funds shall be examined annually by Auditor.
What will Auditor check? Auditor shall check whether Cash and Securities value equals the amount that should have been in Sinking Fund. This calculation assumes: Section 148 investments were made regularly; investment interest was regularly received.
Expected Sinking Fund Amount: Expected amount is calculated on basis of payments made under Section 145.
Value of Securities: Generally Current Value shall be taken. But if securities become due for redemption at or above face value before maturity, Redemption Value shall be taken as per statutory rule.
In case of Deficit: If Auditor certifies deficit, Municipality shall Forthwith pay the deficit amount into Sinking Fund. Exception: State Government may specially sanction gradual readjustment.
In case of Excess: If Sinking Fund has cash + securities in excess of required amount, Auditor shall certify excess. Thereafter Municipality shall transfer Excess amount → Municipal Fund → General Account.
Dispute on Deficit/Excess: If Municipality disputes accuracy of Auditor's deficit/excess certificate, after initial statutory financial adjustment, matter may be referred to State Government. State Government's decision shall be Final.

16. CHAPTER IX — Commercial Projects
Now a new dimension of the Act begins: Commercial Projects + Private Sector Participation. Its objective is to develop municipal infrastructure on commercial basis and through participation of external agencies.
Section 152 — Commercial Projects
Municipality may undertake commercial infrastructure projects by itself or through Public/Private Sector Agencies. Activities include: planning, construction, operation, maintenance, management.
Examples of Commercial Projects: District Centres, Shopping Centres, Bus Terminals, Truck Terminals, Tourist Lodges with Commercial Complexes, and Other Commercial Projects on commercial basis.
Section 152 — Key Concept: Municipality is not just a tax/fees collecting entity. It can also be a Commercial Infrastructure Developer/Manager.
Section 153 — Project by Municipality/Other Agency
Section 153 allows participation of other agencies in projects of municipal infrastructure and services. But subject to State planning/development/operation/maintenance/management laws.
In context of which Functions? Section 153 relates to discharge of municipal functions specified in Sections 45, 46 and 47.
Who can participate? Municipality may work with: Company, Firm, Society, Trust, Body Corporate, Institution, Government Agency, agency under any other law.
In which Activities can they participate? Other agency may participate in: Financing, Construction, Maintenance, Operation.
Section 153 — Three Modes:
(A) Promote agency participation in urban infrastructure/service project.
(B) Consider/approve private sector company's project under Private Sector Participation Agreement.
(C) Undertake/approve project with Government/other statutory agency.
Section 154 — Private Sector Participation Agreements
Private Sector Participation Agreements shall be as prescribed by Rules. But the Act also provides an illustrative list.

Section 156 — City Development Plan
Every Municipality shall prepare City Development Plan (CDP). Its periodicity, chapters, material, schemes shall be prescribed by Rules made by Government.
City Development Plan — in consultation with whom? First and foremost, in consultation with District Collector and district-level officials.

If in Metro Region: If Municipality is part of a Metro Region, City Development Plan shall be sent to Metropolitan Planning Committee for inclusion in Metro Region Development Plan.
If not part of Metro Region: If Municipality is not part of Metro Region, City Development Plan shall be sent to District Planning Committee for inclusion in District Master Development Plan.
After Planning Committee: Metropolitan Planning Committee or District Planning Committee shall, after due deliberations, include City Development Plan or appropriate elements thereof into Metro Region Development Plan or District Master Development Plan.
Submission to State Government: Plan prepared by Committee shall be sent to State Government for two purposes: 1. Inclusion in State Plan, 2. Government resources allocation for execution of Plan.
